These Terms of Service ("Terms") govern your use of Apps Launch Co's website and mobile app development subscription services. By accessing our website or using our services, you agree to be bound by these Terms.

1. Service Description

Apps Launch Co provides mobile app development services through subscription-based plans:

• Essential Plan ($4,995/month): One app request at a time, Flutter development, iOS & Android apps, source code included, API integrations
• Professional Plan ($7,995/month): Everything in Essential plus custom UI/UX design, user authentication, payment processing, push notifications, priority support
• Enterprise Plan ($12,995/month): Everything in Professional plus multiple requests in queue, backend development, native code when needed, real-time features

All plans include unlimited revisions, the ability to pause or cancel anytime, full source code ownership, iOS & Android deployment assistance, and 15+ years of mobile development expertise.

2. Subscription Terms

Billing and Payment

• Subscriptions are billed monthly in advance through Stripe
• Payment is due immediately upon subscription activation
• All fees are non-refundable due to the high-quality, custom nature of the work
• You may upgrade or downgrade your plan at any time

Pause and Cancellation

• You may pause your subscription at any time without penalties
• You may cancel your subscription at any time
• Paused or cancelled subscriptions retain access until the end of the current billing period
• No partial refunds are provided for unused portions of billing periods

3. Service Delivery

Development Process

• Work is delivered iteratively with regular progress updates
• Average delivery time is 7-14 days, but may vary based on complexity
• Essential and Professional plans work on one request at a time
• Enterprise plans can queue multiple requests
• All work includes unlimited revisions until client satisfaction

Technology and Scope

• Primary development is done using Flutter for cross-platform compatibility
• Native iOS (Swift) and Android (Kotlin) development available for Professional and Enterprise plans when needed
• We specialize in mobile apps; web applications are not included unless specifically agreed upon
• Third-party service integrations are included as specified in plan features

4. Intellectual Property

Source Code Ownership

• You retain full ownership of all source code developed for your projects
• Source code is provided upon completion of each development milestone
• You are responsible for maintaining and updating the code after delivery

Content and Materials

• You must provide all necessary content, assets, and materials for your app
• You warrant that you have the right to use all provided materials
• You are responsible for ensuring content complies with applicable laws and platform policies

5. App Store Deployment

Standard Deployment

• We assist with App Store and Google Play store submissions as part of our service
• You are responsible for obtaining and maintaining your own developer accounts
• App approval is subject to platform policies and guidelines
• We cannot guarantee approval, but will work with you to address any issues
• You are responsible for ongoing app store compliance and updates after deployment

Alternative: Publishing Under Our Developer Account

If you prefer not to maintain your own developer accounts, we offer an alternative publishing service:

• We can publish your app under our Apple and Google developer accounts
• Additional fee: $500 per year (billed annually)
• This covers both iOS App Store and Google Play Store publishing
• You retain all intellectual property and app ownership rights
• We handle app store compliance, updates, and maintenance
• Revenue and customer data remain entirely yours
• You can transfer the app to your own developer account at any time (standard transfer processes apply)
• This service must be arranged before initial app submission

Note: Publishing under our developer account does not change app ownership or intellectual property rights. This is purely a convenience service to eliminate the need for you to manage developer account compliance and administrative tasks.

6. Client Responsibilities

• Provide clear, detailed requirements and specifications
• Respond promptly to requests for feedback and clarification
• Provide necessary assets, content, and third-party service credentials
• Maintain current payment information and billing details
• Comply with all applicable laws and platform policies
• Test delivered applications and provide timely feedback

7. Warranties and Disclaimers

Service Quality

We warrant that our services will be performed with professional skill and care consistent with industry standards. We will work diligently to deliver high-quality mobile applications that meet your specifications.

Disclaimers

• We cannot guarantee app store approval or market success
• Third-party service integrations are subject to their respective terms and availability
• Performance and scalability depend on various factors including hosting and usage patterns
• We are not responsible for changes in platform policies or technical requirements after delivery

8. Limitation of Liability

To the maximum extent permitted by law, Apps Launch Co's total liability for any claims arising from these Terms or our services shall not exceed the amount you paid for services in the 12 months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

9. Termination

Either party may terminate these Terms:

• For any reason with appropriate notice (subscription cancellation)
• Immediately for material breach of these Terms
• Immediately for non-payment after reasonable notice and opportunity to cure

Upon termination, we will complete any work-in-progress within a reasonable timeframe and provide all completed deliverables.

10. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. We implement appropriate security measures to protect your data and project information.

11. Communication and Support

• Primary communication is conducted via email and scheduled calls
• Professional and Enterprise plans receive priority support
• Response times may vary but we strive to respond within 24-48 hours
• Emergency support is available for critical production issues

12. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email with at least 30 days' notice. Continued use of our services after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Colorado.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Apps Launch Co regarding our services and supersede all prior agreements and understandings.
